TERMS AND CONDITIONS FOR CREDIT CARD PAYMENTS AND ELECTRONIC COMMUNICATIONS

These Terms and Conditions apply to all users of the site, including, without limitation, users who are browsers, vendors, customers, merchants, and/or contributors of content.

(a) “Roll-A-Shade”, “we”, “us”, and “our” refer collectively to Roll-A-Shade Inc., and all of its divisions, subsidiaries and affiliates, such as Automated Motorized Shades.
(b) “You” means you, the website browser, vendor, customer, merchant, and/or contributor of content to this website.
(c) “Product” or “Products” means any product provided by us, such as window shades, window coverings, or any other product.
(d) “Service” or “Services” means any service provided by us, such as window shade installation, shade printing, or any other service.
(e) “Electronic Communications” means any electronic billing and payment communications sent by us to you or by you to us, such as online access to statements and emails relating to billing or payment, disclosures, notices and other communications regarding our products and/or services.
(f) “Credit cards” includes both credit cards and debit cards.
SECTION 3 â€“ ONLINE STORE TERMS
By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products, services, or website for any illegal or unauthorized purpose. You must not transmit any worms or viruses or any code of a destructive nature.
All users of this site agree that access to and use of this site is subject to the following Terms and Conditions and other applicable law. If you do not agree to these Terms and Conditions, please do not use this site.
SECTION 4 â€“ GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms and Conditions.
SECTION 5 â€“ SECURE CARD PROCESSING
All credit card transactions that occur on our website are processed securely by encrypted transmission systems. When you make your online payment on our website we do not store credit card information, nor do we actually see your credit card information when it is entered by you on your computer.
SECTION 6 â€“ AUTHORIZATION
By entering your credit card information:
(a) You are stating that you are an authorized user of the credit card and that the associated information entered (account holder name, account number, expiry date, CVV2/CVC2 security number, billing address, etc.) is accurate.
(b) You authorize us to charge the amount you have requested to your credit card.
(c) If you set up automatic payments, then you authorize us to charge the amount due for the invoice being paid to the credit card.
(d) You also authorize us to return to your credit card any funds due to you by us resulting from your credit card payments on this site.
SECTION 7 â€“ CHARGES
We may not know the dollar amount of certain extra charges at the time of a prepaid order, including, but not limited to, shipping charges. These extra charges will be disclosed to you once we know them, and prior to the extra charges being made to your credit card.
For each transaction, in addition to the charge you have authorized, your credit card issuer and network may assess their customary transaction or handling charge, if any.
Foreign payments are defined as a payment made to a merchant located in a different country than the payment method was issued is (e.g., a credit card issued in Canada paying a merchant in the United States). Foreign payments may be subject to higher fees by the credit card issuer.
If a charge is declined or reversed by the credit card issuer or network, you agree to pay us a service charge and to reimburse us for all reasonable costs of collection. Your credit card issuer may also assess its customary charge for such transactions.
For fraud prevention, we reserve the right to impose limitations on the size, frequency, and time frame of payments per user.
Contact us as soon as possible at 1-888-245-5077 if you think that the amount of your online payment to us shown on your credit card statement is in error or if you need more information about your payment to us shown on your credit card statement.
By clicking “Submit” you are agreeing not to make a fraudulent dispute of the payment you have authorized with your credit card issuer. This type of fraud is costly. As such, to keep our prices low, we may attempt to prevent such fraudulent chargebacks by requiring an authorized signature for acceptance of product deliveries and services, requesting security codes when entering your credit card, and keeping a record of your IP address when a payment is made.
SECTION 8 â€“ DISHONORED REQUESTS FOR PAYMENTS
If your credit card issuer or network does not honor an online payment transaction, then we have the right to charge the amount of any such transaction to your account or to collect the amount from you.
If your credit card issuer or network does not honor an online payment transaction, we may terminate any or all product delivery or service, and we may cancel your right to participate in online payment on our website.
SECTION 9 â€“ CONFIRMATION OF PAYMENT
By clicking “Submit” you are consenting to receive a one-time confirmation of this payment electronically to the email address you have provided to us.
If you set up automatic payments, then you are consenting to receive a one-time confirmation of each payment electronically to the email address you have provided to us.
SECTION 10 â€“ RETURN POLICY
Please note that we do not accept returns without a return authorization number. You must first obtain a return authorization number from us before returning goods to us to receive a refund or a credit on your account. You may contact us at 1-888-245-5077 to request authorization for your return.
Returns may be subject to a restocking fee. Any restocking fees, if applicable, will be disclosed when the return authorization number is issued.
We ask that you carefully examine the shipments you receive, and in the event of any shipping damage to the goods and containing cartons, and please keep the cartons. Our carriers do insure against damage but they will not entertain a claim without clear evidence.
SECTION 11 â€“ GOODS AND/OR SERVICES WARRANTY
We guarantee all products manufactured in our facilities to be free from defects due to workmanship or materials under normal usage.
We guarantee, to the original purchaser, our manual shades with a limited lifetime warranty, our motors with a 5 year limited warranty, our printed shades with a 3 year warranty against fading and our bead chains for a period of up to 1 year from the date of installation.
This guarantee does not apply to damage to exterior shades due to high winds from extreme weather conditions, any roller shade or parts that fail due to abuse, neglect, accident, alterations, improper use or installation, theft or gradual color fading due to extreme direct sunlight.
For claims covered by the guarantee, we will replace or repair any product found to be defective as a result of faulty workmanship or materials. Shipping charges, trip charges and labor costs for measuring and installation and/or removal of old or current products are excluded. This warranty is available to the original owner and is non-transferable.
Roll-A-Shade® warrants Eclipse to be free from defects in materials and workmanship for 5 years when used properly and operated under normal conditions from the date of purchase. If Eclipse is found to be defective and covered by the warranty, we will, at our option, repair or replace it free of charge. This product warranty does not cover any conditions or damages resulting from misuse or abuse, accidents, alterations, neglect, damage by others, natural disasters, exposure to the elements, or failure to follow Roll-A-Shade’s instructions with respect to installation, use and maintenance. The repair or replacement of defective product is the purchaser’s sole remedy and the limit of Roll-A-Shade’s obligation.
EXCEPT AS EXPRESSLY PROVIDED IN THIS PARAGRAPH, ROLL-A-SHADE® MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, NATURE OR DESCRIPTION, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS OF ANY PRODUCTS FOR ANY PARTICULAR PURPOSE, AND HEREBY DISCLAIMS THE SAME.
In no event shall Roll-A-Shade® be liable or responsible for incidental or consequential damages or for any other direct or indirect damage, loss, cost, expense or fee.
Roll-A-Shade’s warranty is designedto ensure a thoroughly satisfying experience with your window treatment product.
SECTION 12 â€“ LIMITATION OF LIABILITY
We shall not be liable for any special or consequential damages that result from the use of, or the inability to use this site.
We do not guarantee, represent or warrant that your use of our website will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from your use of the website will be accurate or reliable.
You agree that from time to time we may remove products or services from our website for indefinite periods of time or cancel products or services from our website at any time, without notice to you.
You expressly agree that your use of, or inability to use, the website is at your sole risk.
In no case shall we, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the website, even if advised of their possibility.
